Dispute Resolution

Dispute resolution lawyers who prefer outcomes to noise.

When a commercial or personal relationship breaks down, Hami Legal Services gives you an honest assessment, a clear strategy and determined representation through negotiation, mediation, litigation or arbitration.

An early, candid assessment

The most valuable advice in a dispute is often given in the first weeks. We review the documents, test the facts and give you a frank view of the strengths and weaknesses of your position, the remedies realistically available and the likely cost of pursuing them. That assessment becomes the reference point for every later decision.

Where a claim is weak, we will say so. Where it is strong, we will help you use that strength to achieve a resolution on favourable terms.

Negotiation and mediation

Most disputes end in agreement, and the sooner a fair agreement is reached the less it costs. We conduct settlement negotiations, prepare persuasive correspondence and represent clients in mediation. A well-prepared case for settlement is built on the same rigour as a case for trial, which is why the other side takes it seriously.

Litigation

When proceedings are necessary, we act for claimants and defendants in commercial, contractual, shareholder, property and debt disputes. We prepare pleadings and evidence with care, manage disclosure efficiently and work with experienced advocates where a hearing requires it. You will be kept informed of each step, its purpose and its cost.

Disputes we handle

Our dispute resolution work covers the disagreements that most often affect businesses and their owners: breach of contract and claims under commercial agreements, disputes between shareholders or business partners, claims arising from the sale or purchase of a business, recovery of unpaid debts, property and lease disputes, and disagreements over the ownership or use of intellectual property.

We also act for individuals in personal disputes about property, money and inheritance, where discretion and a measured approach are often as important as the legal arguments.

Arbitration

Many commercial contracts provide for disputes to be decided by arbitration rather than the courts. We advise on arbitration agreements at the drafting stage and represent parties in arbitral proceedings, from the notice of arbitration through to the award and its enforcement.

Securing the result

A judgment or award has value only when it is honoured. We advise on enforcement options from the outset, so that the route chosen to win a dispute is also a route to recovering what is owed. Before a claim is issued, we consider whether the other party has assets that can be reached and whether protective steps are needed to preserve them.

Questions clients ask

Should I respond to a letter threatening legal action?

Yes, but carefully. What you say at this stage can affect the outcome later. Send us the letter and the key documents, and we will advise on a response that protects your position.

Is going to court always necessary?

No. Many disputes are resolved through negotiation or mediation. We recommend proceedings only where they are the most effective way to achieve your objective.

How are the costs of a dispute managed?

We discuss likely costs at the outset and at each significant stage, so that every decision to proceed is taken with a clear view of the expense involved.
